I certify that the answers given by me to the foregoing questions and statements are true and correct to the best of my knowledge without material omissions of any kind.  I agree that TOMS SHOES, LLC (“TOMS”) shall not be held liable in any respect if my employment is rejected or subsequently terminated because of false statements, answers or omissions made by me in this application.  I understand that any omission or misleading or incorrect statements of material fact on this document or on any document used to secure my employment shall be grounds for rejection of this application, and if I am employed by TOMS, may lead to termination of my employment, regardless of the time elapsed until discovery.

 I understand that TOMS reserves the right to request business references from me during this application process.  If TOMS does make such a request and I provide any references I hereby authorize TOMS to thoroughly investigate my references, work record, education and other matters related to my suitability for employment and further authorize the companies, schools and persons provided to TOMS to give any information requested regarding my former employment, character and/or qualifications. I hereby voluntarily and knowingly fully release and discharge, absolve, indemnify, and hold harmless TOMS from and against any and all claims, demands, or liability arising out of or in any way related to such investigation or disclosure

I agree that any dispute between me and TOMS arising out of or relating to my application for employment will be submitted to individual binding arbitration in accordance with the employment dispute arbitration rules of the American Arbitration Association, which can be obtained at www.adr.org or a copy may be obtained from Human Resources.  As part of this agreement, both TOMS and me agree to waive any right to make any claims on a representative or class basis to the fullest extent permitted by law.  Any issues regarding the scope or validity of this arbitration agreement shall be decided by a court of competent jurisdiction and not the arbitrator.  If I become employed by TOMS, I understand and agree that I will be required to sign the TOMS Mutual Agreement to Arbitrate Claims as a condition of employment.

Candidate Sign Off

All employment with TOMS is on an at-will basis, unless specified otherwise in a written employment agreement signed by the Chief Executive Officer of TOMS. If hired, as an at-will employee, I understand that I may resign at any time and that TOMS may terminate my employment at any time for any reason, with or without cause or notice, subject to applicable state and federal law.
